Terms of Service

1. Acceptance

By signing up, signing in, or otherwise using the Service, you confirm that:

• You have read and agree to these Terms and our Privacy Policy.
• You are at least 13 years old (or the minimum age required in your country). If you are under 18, you have a parent or guardian’s permission.
• The information you provide at signup is accurate.

We may update these Terms from time to time. If we make material changes, we will post an updated date and, where appropriate, notify you in the Service or by email. Continued use after the effective date means you accept the updated Terms.

2. The Service (soft beta)

Bragline is a social fitness product. Features may include profiles, Bragline Score and boards, friends, posts, and emoji reactions (cheers). V1 does not include direct messaging.

Soft beta / soft unlock. During soft beta, parts of the Service may be offered free of charge for a limited time. Soft unlock does not create a payment obligation, does not guarantee that free access will continue, and does not promise any specific feature set, uptime, or launch date. Features may change, break, or be removed without notice.

We do not promise that the Service will be uninterrupted, error-free, or available in every location.

3. Accounts

You are responsible for:

• Keeping your password and login credentials confidential.
• All activity under your account.
• Notifying us promptly if you believe your account was compromised.

One person, one account, unless we expressly allow otherwise. Do not sell, share, or transfer your account. We may reclaim usernames that violate these Terms or that we need for brand or safety reasons.

How to leave: You may delete your account at any time. See Delete your account and Settings → Account → Delete account in the product.

4. Username and content standards

You agree not to post, upload, or share content (including usernames, bios, photos, videos, captions, comments, or emoji reactions) that:

• Is NSFW, pornographic, or sexually explicit.
• Promotes hate, harassment, threats, or violence against people or groups.
• Is bullying, doxxing, or intended to shame or abuse others.
• Infringes someone else’s rights (copyright, trademark, privacy, publicity).
• Is illegal, fraudulent, or deceptive.
• Impersonates another person or misrepresents your affiliation.
• Contains malware, spam, or attempts to scrape or disrupt the Service.
• Encourages dangerous or extreme behavior that could seriously harm someone.

We may remove content, limit features, or ban accounts that violate these standards, with or without prior notice, depending on severity. Repeat or severe violations (NSFW, hate, threats) may result in an immediate permanent ban.

Report abuse: Use in-product report tools where available, or contact support (see §14).

5. Fitness disclaimer

Bragline Score, streaks, boards, estimates, and similar metrics are for entertainment and motivation only. The Score is an estimate derived from activity inputs (for example MET-based formulas). It is never presented as calories burned or as a medical measurement.

They are not:

• Medical advice, diagnosis, or treatment.
• Professional fitness coaching tailored to your health.
• Calorie counts, nutrition advice, or clinical measurements.

Always consult a qualified professional before starting or changing an exercise program, especially if you have a medical condition, injury, or disability. You use fitness features at your own risk. Stop if you feel pain, dizziness, or other warning signs, and seek medical help when appropriate.

6. Your content and license

You keep ownership of content you create and submit to the Service (“User Content”).

To operate Bragline, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (e.g. resize images), display, distribute, and otherwise use your User Content solely to provide, improve, promote, and secure the Service. This includes showing your content to other users according to your privacy and sharing settings.

You represent that you have the rights needed to grant this license and that your User Content does not violate these Terms or applicable law.

When you delete content or your account, we will remove User Content from active systems as described in our Privacy Policy and Delete your account. Copies may remain briefly in backups or caches, and we may retain limited records where required by law.

7. Boards, friends, and cheers

Bragline is meant to be supportive. When you use boards, friends, cheers, comments, or similar social features, you agree to:

• Be respectful. Cheer effort; don’t pile on or shame people.
• Not manipulate boards with fake accounts, bots, or cheating.
• Not spam cheers, follows, or reactions.
• Respect others’ boundaries if they block, mute, or ask you to stop.

We may hide, demote, or remove social activity that violates these expectations, and we may restrict or ban accounts that repeatedly abuse social features.

8. Our intellectual property

The Service—including branding, design, software, and original content we provide—is owned by Bragline or its licensors. You may not copy, modify, reverse engineer, or create derivative works from our software or branding except as allowed by law or with our written permission.

“Bragline” and related marks are our trademarks. You may not use them in a way that confuses people or suggests endorsement without permission.

9. Third-party services

The Service may link to or integrate third-party sites or tools. We are not responsible for their content, policies, or practices. Your use of third parties is between you and them.

10. Soft beta, free access, and future paid features

During soft beta / soft unlock:

• Access may be free and time-limited.
• No payment is required to use soft-unlocked features during that period, unless we clearly offer a separate paid product and you choose it.
• Free access can end or change when beta ends or when we announce pricing.

If we later offer paid subscriptions or in-app purchases (including on Apple App Store or Google Play), additional store terms and billing rules will apply. Digital goods sold through those stores are generally handled by the store’s refund and cancellation rules.

11. Termination and bans

You may stop using Bragline and delete your account at any time (Delete your account).

We may suspend or terminate access, remove content, or ban an account if:

• You violate these Terms or our policies.
• We reasonably believe your account poses a safety, legal, or security risk.
• We discontinue the Service or a portion of it.

Where practical, we will provide notice. For serious violations (e.g. NSFW, hate, threats, fraud), we may act immediately. Ban decisions are final except where we choose to review an appeal sent to support.

Provisions that by nature should survive (including disclaimer, limitation of liability, indemnity, and license for content already shared as required to operate historical displays until purged) survive termination.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR NEEDS OR BE SECURE, ACCURATE, OR ERROR-FREE.

Fitness-related outputs are estimates and motivational tools only (see §5).

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAGLINE AND ITS OWNERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50 if you have not paid us.

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent allowed. Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence where such limitation is prohibited).

15. General

• Entire agreement. These Terms plus the Privacy Policy are the entire agreement between you and us about the Service.
• Severability. If a section is unenforceable, the rest remains in effect.
• No waiver. If we don’t enforce a provision once, we still may later.
• Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
• Governing law. These Terms are governed by the laws of the State of [Texas / TBD], excluding conflict-of-law rules, unless mandatory consumer law in your country says otherwise. Venue for disputes will be the state or federal courts located in [TBD], unless applicable law requires otherwise.
• Export / sanctions. You may not use the Service if you are prohibited under applicable export or sanctions laws.

16. Apple App Store / Google Play notices (for native / wrapper builds)

If you download Bragline from Apple’s App Store or Google Play:

• These Terms are between you and Bragline, not Apple or Google.
• Apple and Google have no obligation to provide maintenance or support for the app.
• To the extent any warranty applies and is not effectively disclaimed, Apple’s or Google’s responsibility is limited as described in their standard EULA / store terms (e.g. refund of the app purchase price where applicable).
• Apple and Google are third-party beneficiaries of the end-user license provisions that protect them; upon your acceptance of these Terms, they have the right to enforce those provisions against you.
• You represent you are not in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and you are not on any U.S. Government prohibited or restricted party list.
